Purchasing Responsibility

ILEY'COM is a marketplace connecting independent buyers and sellers . Each seller is fully responsible for the products they offer, including their compliance with applicable standards, their safety, and their impact on health.

By making a purchase on ILEY'COM, the buyer acknowledges that the responsibility for the quality, authenticity and conformity of the product lies exclusively with the seller . ILEY'COM does not manufacture, store or ship any products and therefore cannot be held responsible for any problems related to the use of the purchased items, including in the event of an allergic reaction, adverse effect or any other health incident resulting from their use.

In the event of a dispute or claim , the buyer must contact the seller concerned directly to find a solution. ILEY'COM may facilitate communication between the parties, but cannot be held responsible for any damages or losses related to a purchase.

General Conditions of Sale (GCS) - Buyer

1. Purpose
The purpose of these General Conditions of Sale (GCS) is to define the rights and obligations of the parties in the context of the sale of products or services on the Ileycom marketplace.

2. Acceptance of the T&Cs
Purchasing on Ileycom implies full acceptance of these T&Cs by the buyer.

3. Products and Responsibilities
Products are sold directly by sellers registered on Ileycom . Each seller is solely responsible for the quality, conformity, and availability of the products they offer. The buyer is responsible for their choice and purchase. Ileycom acts solely as an intermediary and cannot be held responsible for the products sold.

4. Price and Payment
Prices are displayed in the buyer's local currency and may or may not include taxes, depending on applicable regulations. Payment is made using the payment method indicated below.

5. Order
Any confirmed order constitutes a firm commitment from the buyer. An order confirmation is sent by email.

6. Delivery
Delivery times are provided by the seller. Ileycom cannot be held responsible for any delays or problems related to delivery.

7. Right of Withdrawal
The buyer has 15 days to exercise their right of withdrawal, except for exceptions provided for by law. Any request must be addressed directly to the seller concerned.

8. Guarantees and Returns
Products are covered by the legal guarantee of conformity and hidden defects. Any complaints regarding a product must be addressed directly to the seller concerned.

9. Responsibilities

• The buyer is solely responsible for his purchase and use of the product.
• The seller is solely responsible for the products he puts on sale on Ileycom.
• Ileycom acts only as a platform and declines all responsibility related to transactions between buyers and sellers.

10. Personal Data
Personal information collected is processed in accordance with the site's privacy policy.

Products

We make every effort to display as accurately as possible the colors, features, specifications, and details of the products available on the Site. However, we do not guarantee that the colors, features, specifications, and details of the products will be accurate, complete, reliable, current, or error-free, and your electronic screen may not accurately reflect the actual colors and details of the products. All products are subject to availability, and we cannot guarantee that items will be in stock. We reserve the right to discontinue any product at any time and for any reason. Prices for all products are subject to change.

Return/Refund Policy

Please review our return policy posted on the site before making any purchase.

Payment method

You agree to provide current, complete, and accurate purchase and account information for all purchases made on the Site. You also agree to promptly update payment information, including email address, payment method, and payment card expiration date, so that we can complete your transactions and contact you as needed. Sales tax will be added to the price of purchases if we deem it necessary. We may change prices at any time. All payments must be made in either Dinars (TND), Euros (€), Dollars ($), or British Pounds (£).

We use secure payment terminals and accept various online payment solutions in your country's currency.

For buyers in Tunisia, you can use the Click to Pay app to pay online or pay on delivery.

Funds Management : Payments made by the buyer are held in escrow by Ileycom until delivery is confirmed. Once the transaction is finalized, the funds are released to the seller.

*We keep the money from your purchase in our account to secure your order, once you confirm receipt of your purchases, the supplier receives the money collected otherwise you will be refunded.

Customs fees

Customs fees and import taxes : The buyer is solely responsible for paying any customs fees and import taxes applicable in his country.

Customs Declaration : Some products may be subject to customs restrictions. It is the buyer's responsibility to verify that the product complies with their country's regulations before purchasing.

Sellers' Responsibility : Sellers must provide the necessary documents for customs declaration, but Ileycom is not responsible for any delays or additional costs due to customs procedures.

Non-payment of customs duties : In the event of non-payment of customs duties by the buyer, the product may be retained or returned to the seller, without the possibility of refunding the order.

IOSS (Import One-Stop Shop) Regulations : For sales to the European Union, sellers must comply with the IOSS regime where applicable. Ileycom may collect and remit VAT for orders under €150, in accordance with IOSS rules. Above this amount, the buyer is responsible for paying taxes and customs duties upon receipt.

Disputes between Buyer and Seller

In the event of a dispute between a buyer and a seller, the parties must first attempt to resolve the dispute amicably by communicating via the means made available by Ileycom.

If no agreement is reached within 15 days, the buyer and seller can request the Ileycom mediation service , which will attempt to help resolve the dispute.

As a last resort, any unresolved dispute will be submitted to the competent courts of the country where the seller is established.

Conditions of sale

To be eligible to use our ILEY'COM Marketplace, you must meet the following criteria:

• The signing of the partnership agreement , which describes the terms and conditions of collaboration between the two parties in the context of the use of the Marketplace. It will be communicated via email and could be signed within a period not exceeding one month from its receipt.
• The agreement takes effect from the date of signature and ends 12 months after this date.
• The seller displays their products in a transparent manner and makes sure to clearly describe the components of each product to share all necessary information with customers. They are primarily responsible for the health of buyers. They must only sell products with a expiration date of more than 3 months.

Conditions of sale abroad

To sell abroad, you must first meet all the criteria for selling in Tunisia as mentioned in the agreement, as well as follow the following conditions:

• The seller must have storage in ILEY'COM premises – (only products in ILEY'COM stock will be displayed abroad for the international market)
• ILEY'COM gives you the opportunity to sell for free for the first year on other sales channels such as ( Etsy, Amazon Handmade or others)
• The packaging of products sold internationally must be eco-responsible and designed to withstand travel abroad.

Conditions of sale in Tunisia

• Have legal status in Tunisia
• The seller must be a craftsman , farmer or social entrepreneur
• The seller is primarily responsible for the health of buyers and must not use toxic products in the manufacture of his products.
• The seller is primarily responsible for the health of buyers who order gourmet products and must only offer products that are at least 3 months old.
